Inquiry #1: In recent District 2 Caltrans 2010 training (AGC and industry at large training) contractors were assured that there was no intent to deceive bidders by not providing bid items for Division II requirements that are customary in pre-2010 contract documents. This job has bid items for WQ Sampling and Analysis Day, WQ Monitoring Report, Temp Clear Water Diversion, Bird Deterrent, In-Stream Habitat Enhancement. However, no bid items are provided for Fish Salvaging, Fish Salvage Plan, and Contractor Furnished Biologist as required in Section 9. Payment for this work is then incidental to work in the Bid Item List. Whether intentional or not, this is exactly what we were told Caltrans did not intend.

Inquiry #2: The Fish and Game SAA 2.10 states a continuous construction presence SHALL be in effect without interruption from May 15 until August 31, or until such time the project is complete. (emphasis added). SP 14-6.11 indicated that if you can not start bird deterrence by May 15, you can not start work.
Is bird deterrence required from the start of work through completion, or from May 15 through completion?

Response #2:2/8/13: Per Special Provision 14-6.11, Bird Deterrent, " Bird deterrence is required from May 15 to completion of construction activities. If you can not begin bird deterrence by May 15 you may not begin job site activities." Please bid per the contract documents. In addition, please refer to Section 13 of the Special Provisions, Water Pollution Control.

Inquiry #3: 1)Several of the SP have a payment section that reads similar to, "SP 13-11.04 Payments, Not used." Pay items are in the schedule to cover the referenced work. It is unclear what the SP language is indicating. Please clarify.
2)Sheet 7 shows ESA fence in the NW quadrant that is inside the drainage easement shown on sheet 2. This ESA fence goes through the temporary stream crossing shown on sheet 5 and effectively eliminates accessing the work from this quadrant. Please clarify if access is allowed from the NW quadrant, within the easement/ROW, down to the work.
3)When advance flaggers are required the State has indicated this in the special provisions. Sheet 11a note 7 indicates that advance flaggers may be required. We find no reference to advance flaggers in the SP. Please indicate if advanced flaggers are required.

1) Please refer to paragraph 14 of section 1-1.01, and section 9-1.03 of the standard specifications.
2) Per section 13-7.03C(1) of the special provisions, temporary construction roadways may not be constructed on the west banks of Mill Creek.
3) Advance flaggers may be required to comply with section 7-1.03 and 7-1.04 of the standard specifications. Payment for flaggers is covered in section 12-1.03 of the standard specifications.
