Caltrans is leveraging its decades of expertise in successfully delivering highway projects to meet the goals and purpose of the Middle-Mile Broadband Initiative. Leveraging the authority included in Senate Bill 156 (2021), Caltrans is using the innovative delivery methods – Job Order Contracting (JOC) and Construction Manager/General Contractor (CMGC) – to deliver the Middle-Mile Broadband Network projects. The contracting delivery method will depend on the level of complexity based on environmental and right of way permitting needs, federal land involvement and railroad crossings.

The Construction Manager/General Contractor (CMGC) delivery method procures a contractor, based on qualifications, to serve as a “construction manager”. CMGC is an alternative delivery method that allows Caltrans to engage a construction manager during the preconstruction phase (aka design phase) of a project to provide input. At the conclusion of preconstruction, if Caltrans and the construction manager negotiate the Agree-To-Price for construction of the work package, and the construction manager becomes the general contractor. The work package is then issued as an individual construction contract, which include project plans and specifications, similar to traditional Design-Bid-Build construction contract. However, if the fair and reasonable price is not agreed to, the project will be advertised as a traditional Design-Bid-Build construction contract.

The Construction Manager/General Contractor (CMGC) contracts will also include SB and DVBE targets. The CMGC Request for Qualification (RFQ) advertisement is subject to the Caltrans’ policies related to Small Business and Disabled Veteran Business Enterprise.  Proposers shall be fully informed of the requirements of the regulations and the related policies. Construction Managers responsible for the work from this RFQ must undertake all necessary and reasonable measures to ensure that SBs and DVBEs have the maximum opportunity to compete for and perform work on any construction contract that stems from the preconstruction services contract. Prior to issuing individual construction contracts, Caltrans will collaborate and partner with the CMGC contractor on subcontracting opportunities, including for small businesses and disabled veteran businesses, for each work package (construction contract).
