The responses to bidder's inquiries, unless incorporated into a formal addendem to the contract, are not a part of the contract and are provided for the bidder's convenience only. The availability or use of information provided in the responses to bidder's inquiries is not to be construed in any way as a waiver of the provisions of Section 2-1.03 of the Standard Specifications or any other provision of the contract, the plans, Standard Specifications or Special Provisions, nor to excuse the contractor from full compliance with those contract requirements. Bidders are cautioned that subsequent responses or contract addenda may affect or vary a response previously given.
Q1) Stage Construction and Traffic Handling Plan Stage 2, shows live traffic being directed through the construction zone. Are we to assume that this stage is to be performed under live traffic? Please clarify.
A1) Reference Special Provisions section 10-1.13 "Maintaining Traffic", "Chart No. 1" and Stage 2 plan sheets SC-3 and SC-4. Contractor to provide at least one through traffic lane, not less than 11 feet in width, for use by both directions of travel. Please note the hours in which the contractor is allowed to provide just one traffic lane open. 21Ju11.
Q2) Typically temporary alternative crash cushion systems, temporary crash cushion modules damaged by public traffic will be paid for as extra work as provided in section 4-1.03D of the standard specifications. It seems that in this contract the specials are stating that if the temporary alternative crash cushion system is damaged it shall be replaced at the contractors expense. Was the intent for the specials to say this or is it a mistake? Seems like this could be a very costly item to Caltrans if in fact the contractor shall assume he is 100% fully responsible for the item everytime it gets damaged by public traffic. Please Clarify.
