Inquiry #9: Level 2 project without an Active Treatment System bid item; please explain how the Contractor is to handle / treat water that could be "dirt" as it leaves the site?

Inquiry submitted 12/19/2012

Response #1:Submitted for consideration.
Response posted 12/20/2012

Response #2:Based on the soil condition at the project site, no Active Treatment System is recommended.
Response posted 12/21/2012

Inquiry #10: Follow-up to question #9 - the State is indicating that there is no recommendation for an Active Treatment System. Our QSD (based on review of the plans and knowledge of the area) is recommending a system due to the existing terrain and amount of potential rain water coming onto the site. Along with Water Pollution Control Quantities (WPCQ) (plan sheet WPCQ-1, sheet 22) being slight regarding amount of BMP that are being designed.

Since the States design team and the (potential) project QSD have different opinions regarding the potential risk We now have a follow up question: Who pays for the additional work on a Level 2 project? Our take is this is the State responsibility….. Please review the WPCQ and beef up the design to allow the potential rick can be addressed….

Inquiry #12: Section 5-1.11 states that the contractor is to install exclusion devices prior to February 1st to prevent migratory birds from nesting at the contractor's expense. Since it will not be possible to accomplish this, will the State be installing the exclusion netting? If not, will the contractor be given time extensions if migratory birds do nest and affect the schedule? If Caltrans is installing the devices, please provide details of what the State is installing so we can price the maintenance if the maintenance will be the contractor's responsibility. Also, who pays for the biological monitoring mentioned in this section?
