Claims FAQs
How do I file a claim?
If you feel that you have lost money or property as a result of any action or inaction by Caltrans and your claim is for $5,000 or less, you can file your claim directly with Caltrans. No fee is required for Caltrans claims under $5,000.

Once Caltrans receives my claim form, how long will it take before I receive a response?
Due to the volume of claims, a response can be expected within 6 to 8 weeks of receipt.
If the written response indicates that Caltrans assumes liability, how long before I will receive a check?
Enclosed with the written response will be a release form. After the claimant has returned the completed release form, a check can be expected from Caltrans Accounting within 8 to 10 weeks.
If the written response indicates that Caltrans does not assume liability, what is my appeal process?
There is no further administrative appeal process with Caltrans. An appeal can only be brought in Small Claims Court. For further information on that process contact the Superior Court of California.
What if my claim is over $5,000.00?
If your claim is for over $5000, you can file a claim with the State Board of Control, Government Claims Program. This program gives you the opportunity to formally demand compensation for your loss, and may lead to a settlement of your claim without the need to file a lawsuit.
