The responses to bidder's inquiries, unless incorporated into a formal addendem to the contract, are not a part of the contract and are provided for the bidder's convenience only. The availability or use of information provided in the responses to bidder's inquiries is not to be construed in any way as a waiver of the provisions of Section 2-1.03 of the Standard Specifications or any other provision of the contract, the plans, Standard Specifications or Special Provisions, nor to excuse the contractor from full compliance with those contract requirements. Bidders are cautioned that subsequent responses or contract addenda may affect or vary a response previously given.

Q1) Section 5-1.08 states the "Contractor shall provide a qualified biologist to...instruct", yet under the subsection Training, it states the Dept of Transportation will provide desert tortoise training. The List of Bid Items does not contain a line item for a biological monitor. Is the Contractor required to provide a qualified biologist or will the Dept of Transportation be providing the biologist for this project?

A1) Yes, "the Contractor shall provide a qualified biologist" as stated in the contract provisions.


Q2) Can you provide a list of qualified biologists?

A2) No. The Department does not have a pre-approved list of qualified biologists.


Q3) In order to calculate their cost, to what extent do they need to participate?

A3) Bid as you see fit.


Q4) No Temporary Crash Cushion locations are shown on the site plans. Will any be required, & if so, where will they be located?

A4) Refer to Standard Specification Section 10-1.14 as your bid requires.


Q5) There is a line item (#6) for Temporary Cover, we assume this is for stockpile management though there is no area designated for the materials within the contract limits. Will the stockpile be allowed on-site?

A5) On site stockpiles are to adhere to Special Provisions subsections Material Manangement and Waste Management. Given Section 10-1.06 TEMPORARY COVER of the Special Provisions - "The SWPPP(as approved by the engineer) must describe and include the use of temporary cover as a water pollution control practice for soil stabilization and stockpile management."


Q6) What do the 8 units of Move-in/Move-out Temporary Erosion Control (#7) correspond to?

A6) Please refer to Special Provisions page 43, Section 10-1.10 Move-In/Move-Out (Temporary Erosion Control).


Q7) Are (3) lines of barbed wire actually required, per 80-1.01 para. 2? They aren't shown on any of the plan sheets, nor described in the Specials. My interpretation would be 'No'

A7)Please refer to Section 80, Subsection 1.01, paragraph 2: FENCES of the Standard Specifications. "Type WM shall consist of wire mesh and 3 lines of barbed wire."


Q8) Can the seed mix be revised to include species available this fall?At least 6 seed species will not be available this fall. The seed species are Camissionia claviformis, Eschscholtzia minutiflora, Guillenia lasiophylla, Malacothrix glabrata, Mentzelia eremophila, and Stanleya pinnata. We checked availability with the three major native seed vendors on the west coast.

Q9) Are the soil amendments listed in the table (P.49) Soil Amendments (Type 2) - Site "C" applied in the first step of application and the Soil Amendments in the table on P.50 to be hydroseeded in the last application? If so, the Stabilizing Emulsion, Humic acids, and Kelp extract are liquid and can not be dry applied. Also, the Kelp extract is applied at 10 oz/acre on P.49 and 8 oz/acre on P.50, is this correct?

A9) Bid as specified in Section 10-1.15 EROSION CONTROL (DRILL SEED) MATERIALS, Soil Amendment, Kelp Extract 10 oz/acre and APPLICATION of 0.08 Gallons Per Acre.


Q10) Can we use "or equal" products for the soil amendments? For example, there are other organic fertilizers available close to the 10-2-4 analysis that are considerably cheaper without the Leonardite carrier.

Q11) There doesn't seem to be a Section 5-1.15, nor any reference to Dispute Resolutions in the Index of The Standard Specifications. Would you please clarify?
