The responses to bidder's inquiries, unless incorporated into a formal addendem to the contract, are not a part of the contract and are provided for the bidder's convenience only. In some instances, the question and answer may represent a summary of the matters discussed rather than a word-for-word recitation. The availability or use of information provided in the responses to bidder's inquiries is not to be construed in any way as a waiver of the provisions of Section 2-1.03 of the Standard Specifications or any other provision of the contract, the plans, Standard Specifications or Special Provisions, nor to excuse the contractor from full compliance with those contract requirements. Bidders are cautioned that subsequent responses or contract addenda may affect or vary a response previously given.


Q1) I NEED THE LIQUIDATED DAMAGES PER DAY. I NEED THE AMOUNT ASAP IN ORDER TO GET THE BID BOND AND ALLOW DELIVERY.

A1) Liquidated Damages are found in the Special Provisions Section 8-1.07 LIQUIDATED DAMAGES on page 75 of 284 of the Amendments(Issue date 7-31-09).


Q2) What is bidder's security?

A2) Please refer to Standard Specification 2-1.07 PROPOSAL GUARANTY All bids shall be presented under sealed cover and accompanied by one of the following forms of bidder's security: Cash, a cashier's check, a certified check, or a bidder's bond executed by an admitted surety insurer, made payable to the Director of Transportation. The security shall be in an amount equal to at least 10 percent of the amount bid. A bid will not be considered unless one of the forms of bidder's security is enclosed with it. The bidder's bond shall conform to the bond form in the book entitled "Proposal and Contract" for the project and shall be properly filled out and executed. The bidder's bond form included in that book may be used. Upon request "Bidder's Bond" forms may be obtained from the Department.
