The responses to bidder's inquiries, unless incorporated into a formal addendem to the contract, are not a part of the contract and are provided for the bidder's convenience only. In some instances, the question and answer may represent a summary of the matters discussed rather than a word-for-word recitation. The availability or use of information provided in the responses to bidder's inquiries is not to be construed in any way as a waiver of the provisions of Section 2-1.03 of the Standard Specifications or any other provision of the contract, the plans, Standard Specifications or Special Provisions, nor to excuse the contractor from full compliance with those contract requirements. Bidders are cautioned that subsequent responses or contract addenda may affect or vary a response previously given.
Q) Because of the large quantity of type k barrier and the short, 60 work day time of completion, can previously manufactured, new, or used type k concrete barrier be provided for item 9 on this contract?
A) Refer to Section 12-3.08, "Temporary Railing (Type K)," of the Standard Specifications: "Temporary railing (Type K) shall consist of interconnected new or undamaged used precast concrete barrier units as shown on the plans. Exposed surfaces of new and used units shall be freshly coated with a white color paint prior to their first use on the project." New or used temporary railing (Type K) can be used as long as it also conforms to Section 10-1.17, "Concrete Barrier (Type K)," of the Special Provisions, and Standard Plan T3. If the contractor chooses to furnish used temporary railing (Type K), it must be undamaged. Previously damaged and repaired railing will be rejected.
Q) We read this statement as, this contract does not call for temporary gawk screen panels. Or, does it mean that the k-rail you are requesting has to be new and cannot be used?
A) In Section 10-1.17, "Concrete Barrier (Type K)", of the Special Provisions, second paragraph, "except that removable panels shall not be used" refers to the panels used for openings, as shown in the "Typical Opening Detail" on Standard Plan T3.
