Inquiry #1: The limits of this project is roughly 25 miles. During the project to what extent will the Contractor be responsible as it pertains to vandalism, trash removals, graffiti removal, and protecting existing infrastructure that is not part of our project or is under the full beneficial use of the public. An additional concern is site maintenance is areas where we are no longer working in. For instance, are BMPS required in areas where there is no construction activities taking place. Will we be responsible for any maintenance of this State Highway during the duration of the projects in areas where we are not working or using as a staging area?

Inquiry #2: Will the State allow the contractor to use any of the State's right of way for a construction yard. Since the project is 25 miles long, multiple areas will be needed. Can the State identify the areas of the State right of way that will be available for the Contractor to use for this project?

Response #1:No, the Type Softstop terminal system is the only in-line terminal system end treatment specified in the contract documents.

We do not agree with this. Caltrans Standard Specifications 2015, Section 6-1.05 Specific Brand or Trade Name and Substitution states "reference to a specific brand or trade name establishes a quality standard and is not intended to limit competition. You may use a product that is equal to or better than the specified trade name if authorized".

Further, FHWA Title 23 CFR 635.411 states Federal Funds shall not participate, directly or indirectly, in payment for any premium or royalty on any patented or proprietary material, specification, or process.

The MSKT is a Caltrans approved in-line terminal and we believe it should be allowed for use on this project.

Please review and clarify why Caltrans will only allow the proprietary Softstop on this federally funded project.
