Inquiry #1: For items 15 & 16 there is only one manufacturer that will warranty the material. Also the installation of the tape in areas prone to snowfall could lead to premature failure. These two factors will lead to inflated pricing for the item which is currently substantially more than other alternative striping methods.

Inquiry #2: The Departments attention is directed to the contract items presently listed in the Bid Schedule for the installation of Traffic Stripe Tape (WARRANTY). The specifications for the warranty of this tape are so narrowly tailored it restricts competition between competent vendors by favoring a “sole" source (3M Company). Sole sourcing of materials on Public Works projects is strictly forbidden and the Department and Supplier are treading on the lines of Anti-Trust.

Further, Public Contract Code ARTICLE 4, Preference for Materials SECTION 3400, states in part, “(a) The Legislature finds and declares that it is the intent of this section to encourage contractors and manufacturers to develop and implement new and ingenious materials, and services that function as well, in all essential respects, as materials, products and services that are required by a contract, BUT AT A LOWER COST TO THE TAXPAYERS." Taxpayers will be burdened by the increase in striping this project if Tape is employed as currently specified.

SECTION 3400 Further states “No agency of the state, charged with the letting of contracts for the construction or repair of public works, shall draft or cause to be drafted specifications for bids, (1) in a manner that limits the bidding, directly or indirectly, to any one specific concern”.

The Departments attention is further directed to the California Cartright Act and the Federal Sherman Act.

Please remove or revise the warranty requirements to allow open and fair competition between the tape vendors, or eliminate tape altogether and stripe the project entirely in thermoplastic.

Inquiry #3: Section 84-3 contrast striping, how will this work be paid for? There are approx. 475,499LF of contrast striping (all of the (ModB) thermoplastic striping details) that currently have no pay item. Please advise.
